Apple, Samsung take patent fight to crucial California trial

SAN FRANCISCO (Reuters) - Apple Inc and Samsung Electronics Co Ltd take their battle for mobile supremacy to court on Monday in one of the biggest-ever technology patent trials, a case with the potential to reshape a fast-evolving market they now dominate.

The tech titans will lock horns in a federal courtroom in San Jose, California, just miles from Apple's headquarters. The stakes are high, with Samsung facing potential U.S. sales bans of its Galaxy smartphones and tablet computers, and Apple in a pivotal test of its worldwide patent litigation strategy. Both sides are seeking financial damages from the other.

Samsung has rapidly overtaken Apple, creator of the iPhone and iPad, and Nokia to become the world's largest smartphone maker. Together, Apple and Samsung account for more than half of smartphone sales globally.

Apple sued Samsung last year in San Jose, claiming its smartphones and tablets slavishly copied the iPhone and iPad. The South Korean company countersued. Since then, the two have expanded their fight to courtrooms in nearly a dozen other countries.

At this trial, Apple is seeking at least $2.53 billion in damages, though U.S. District Judge Lucy Koh could triple that figure if she finds Samsung willfully infringed Apple's patents.

The dispute has reached deep into the tech sector, with companies including Microsoft Corp, IBM Corp, Nokia and Research in Motion Ltd filing court papers this week to try to keep their own patent licensing agreements from being disclosed during the trial.

A loss for Samsung could lead to permanent sales bans against products including the flagship Galaxy S III phone, said Nick Rodelli, a lawyer and adviser to institutional investors for CFRA Research in Maryland. While the S III is not at issue in the trial, if Apple prevails the company could later ask Koh to block sales of that product.

Upward of 20 percent of Samsung's global consolidated profit could be affected if it loses this case, he said.

"Samsung is a big company with operations all over the world, but this is actually a needle-mover for them on the bottom line," Rodelli said.

Apple will try to use Samsung documents to show its rival knowingly violated the iPhone maker's intellectual property rights, while Samsung argues Apple is trying to stifle competition to maintain "exorbitant" profit.

In a statement Friday, Samsung said Apple has been "free-riding" on its technology "while using excessive legal claims against our products in their attempt to limit consumer choice and discourage innovation."

An Apple spokesman reiterated the company's previous statement that it wasn't a coincidence Samsung's latest products looked a lot like the iPhone and iPad, and that Samsung blatantly copied its products.

A loss for Apple could be significant, not only if it were ordered to pay financial damages but also because of the competitive threats. That is because the Galaxy S III is a better phone than the latest iPhone 4S, said Michael Yoshikami, chief executive of Destination Wealth Management.

"Apple is all about slowing Samsung down," said Yoshikami, whose fund holds Apple shares. "Apple will try to buy time until iPhone 5 launches," which is expected in October.

Apple shipped 26 million iPhones in the quarter ended in June, fewer than in the previous quarter and well below the 28 million to 29 million that Wall Street had predicted.

Samsung is estimated to have increased sales to around 50 million smartphones. That helped the South Korean giant to report a record quarterly profit of $5.9 billion on Friday.

FINANCIAL DATA COMES TO LIGHT

In the past few days, the companies have supplied some detailed financial data in court filings, such as a disclosure on Thursday that Apple's gross margins for its iPads are about half of those for the iPhones. The information was included in newly unsealed papers and was not previously known, giving Wall Street a rare glimpse into Apple's financial breakdown for specific products.

The companies had initially sought to keep many documents from public view, but Judge Koh rejected the bulk of the requests on July 17. Her order came hours after Reuters filed court papers opposing the companies' efforts to seal the documents.

The lawyers on both sides are well known: Apple is represented by law firm Morrison & Foerster, which led Oracle Corp's patent case against Google Inc earlier this year over the Android operating system. Samsung, whose products run on Android, hired lawyers from Quinn Emanuel Urquhart & Sullivan, which also represents Google and which led Yahoo Inc's short-lived patent lawsuit against Facebook this year.

A 10-member jury will hear evidence over at least four weeks, and it must reach a unanimous decision for Apple or Samsung to prevail on any of their claims.

Apple says Samsung violated four of its design patents, which cover the look and feel of its products. It also says Samsung has infringed three patents for technology such as how the phone distinguishes between scroll and multi-touch gestures.

Meanwhile, Samsung says Apple violated patents on mobile communications systems, as well as features like taking a photo on a phone and seamlessly emailing it.

In a last-ditch attempt to avoid a trial, Apple Chief Executive Tim Cook and Samsung Vice Chairman Choi Gee-sung participated in a mediation on July 16. But a settlement prior to trial is unlikely, sources have told Reuters.

It has been tough going so far for Samsung in the case. Koh halted U.S. sales of the Galaxy Tab 10.1, giving Apple a significant early win. This was followed by a pretrial ban on the Galaxy Nexus phone. Samsung has appealed both orders.

The stakes for Apple are also high due to competitive threats from other Asian phone makers such as China's Huawei Technologies Co Ltd, Rodelli said.

"It's arguably the most commercially and doctrinally significant U.S. patent case in the modern era," he said.

The case in U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, 11-1846.

PHOENIX, Ariz. --?A deputy from a controversial Arizona sheriff's office countered accusations of racial profiling on Thursday, telling a court that he had risked his life to rescue a Latino illegal immigrant from armed kidnappers.

Carlos Rangel told a civil trial alleging Maricopa County Sheriff Joe Arpaio and his office engage in racially profiling Latinos that, at the behest of federal immigration police, he went undercover to play the role of the immigrant's relative to meet kidnappers, one of whom pointed a gun at him.


The kidnappers were arrested and the immigrant was released.

The Justice Department suit accuses Maricopa County, Arizona Sheriff Joe Arpaio of systematically violating the civil rights of Latinos. NBC's Pete Williams reports.

Arpaio, who styles himself "America's toughest sheriff," and his office are defendants in a class-action lawsuit in U.S. District Court in Phoenix that will test whether police can target illegal immigrants without racially profiling Hispanic citizens and legal residents.

The 80-year-old lawman testified this week he was against racial profiling and denied his office arrested people because of the color of their skin.

The case will serve as a precursor to a civil rights lawsuit filed by the federal government, which is much broader.

Feds sue Arizona's Sheriff Joe Arpaio, alleging racial profiling

The plaintiffs, a group of Latinos, say they were discriminated against during sweeps to flush out criminals and illegal immigrants in Maricopa County, which includes the metropolitan Phoenix area. During such sweeps, sheriff's deputies flood an area of a city ? in some cases, heavily Latino areas ? over several days to seek out traffic violators and arrest other offenders.

'Dark-skinned people'
The group accused Arpaio of launching some sweeps based on emails and letters from residents who complained that "dark-skinned people" were congregating in a given area or speaking Spanish. Melendres, a Mexican tourist on a valid visa in a truck was pulled over ostensibly because the white driver was speeding.

Rangel, who arrested Melendres, was asked by plaintiffs' counsel if he had questioned the driver. He told the court he had no grounds to investigate the driver.

When asked by Liddy if he had ever racially profiled anyone while working at the sheriff's office, Rangel, a 13-year veteran of the force, replied: "No".

In later testimony, a Hispanic woman who is a U.S. citizen told the court she was pulled over by a sheriff's deputy in 2009 on suspicion she had drugs, alcohol and weapons in her car as she drove home from studying at a Phoenix valley university.

Despite telling the deputy she was pregnant, Lorena Escamilla said, she was thrown roughly onto the back seat of his patrol car. A subsequent search of her car did not find any drugs. While she was cited for failure to produce identification and not having insurance, charges against her were dropped.

Escamilla said she later filed a charge of assault with Phoenix police department against the deputy and has since been fearful of being pulled over by the officer.

Diona Solis, who is also a U.S. citizen, said the deputy was "rude" and "mocking" and unnecessarily requested identification from the boys in the car aged 8 to 11, among them her son.

"The boys were minors ... I thought it was unreasonable to ask them for IDs ... they hadn't done anything wrong," she said.

TORCH RELAY CONCERT

To celebrate the torch's arrival in London a concert is being held in Hyde Park on Thursday ? the same place where the plug was pulled on Paul McCartney and Bruce Springsteen a few weeks ago after they violated a curfew.

Rees Ianson, 32, was a torch bearer in the north of England and so was given the opportunity to get tickets.

"I jumped at the chance, I'm looking forward to it," says the sales manager from Lincolnshire who was nominated as a torch runner for his charity work.

He's not just down for the concert. Rees also has tickets for basketball and hockey. "I can't wait," he said on his way to the gig featuring the likes of Mark Ronson and Dizzie Rascal.

Kazakhstan is trying to replace two of its male Olympic weightlifters at the 11th hour, possibly because of citizenship issues.

The two are Arli Chontei, in the 56-kilogram category, and Farkhad Kharki, in the 62-kilogram category.

International Weightlifting Federation spokeswoman Aniko Nemeth-Mora says Kazakhstan is citing medical reasons. However, Kazakh weightlifting official Mendikhan Tapsiruly tells AP that "this is most likely to do with the fact they were granted citizenship recently."

Both lifters are originally from China. Two other lifters in Kazakhstan's team were recruited from China, while one switched nationalities from Russia.

Russia's Olympic committee is laying claim to over a dozen athletes born in once-Soviet Ukraine. And it's sparked an outcry in Kiev, the Ukrainian capital.

Some athletes are listed as born in the "Ukraine region" of Russia, while others are listed as coming from the Ukrainian cities of Lutsk and Lviv, which were described as Russian.

Similar mistakes were made for Georgia-born athletes.

The ruling has come down: Saudi Arabia's female judo competitor will not be allowed to wear a hijab during her matches.

TICKETS, ANYONE?

The line to pick up event tickets at the City of Westminster College will-call is snaking through the campus Thursday with fans anxious to get their hands on the prized item. Among them: Michael Perkowski, a contractor for the U.S. military who drove directly to get his tickets after his plane touched down from Afghanistan.

Perkowski says his ticket-buying odyssey began 18 months ago when he was working for the Army in Iraq. He went through the early bidding process and finally scored tickets to three of his 24 choices within the last few months.

Now in Afghanistan working with the U.S. Marine Corps, he says he was coming to the Games regardless of what tickets he landed.

"I don't take too many vacations, so I was doing this no matter what," he says. "We took that long flight, drove forever to come straight here but I don't care. It's all worth it."

Act as if you own the place. That mantra has always served me well, and with those words in mind, I strolled inside the Olympic basketball venue, which wasn't fully open on Wednesday.

As technicians busily dragged cables around the outside of the temporary 12,000-seat structure, where the preliminary rounds are being played, I coolly walked in and watched a few minutes of the Angola women's team practice.

The unique building, erected in just three months, is covered in a white stretch material that will be used for light projections during the games. Its architectural style is similar to the Water Cube swimming complex in Beijing.

Feeling a bit guilty after my self-guided mini tour, I confessed to one of the media leaders that I had already been inside. He didn't seem to mind. "Cheers," he said.

Captain Mark Phillips, Princess Anne's former husband, has spoken of his new relationship with a woman almost 30 years his junior.

The 63-year-old, a top coach for the U.S. equestrian team, separated from his second wife, Sandy, and began divorce proceedings earlier this year after falling for fellow equestrian Lauren Hough, 35.

Phillips, whose daughter Zara is competing in Team GB's equestrian events, has faced criticism and calls for his resignation over his affair with Hough, who is also a member of the American team's coaching staff.

After the Olympics, he will leave his job. But he says it's not because of criticism in the United States.

He told Country Life magazine: "I don't read chatrooms and all that rubbish as it's mostly uninformed and unidentified opinion, which won't change my life.

He's clear about one thing: "I'm not out to win a popularity contest."

AP's Fergus Bell, a Londoner, reports in from the crowded streets of his city:

I took a taxi journey into central London. I usually take the train or Tube because I think they are faster when there are no known problems on the line. Today, with a couple of bags in tow, I had no choice.

It should have taken me 32 minutes, according to a quick online route search.

It didn't.

OK, I knew that figure was a bit optimistic. But I wasn't expecting the driver ? who knows the roads very well ? to get confused by all the new Olympic lanes, end up going a very different route from the one he was expecting. I ended up in the back seat acting as navigator with maps pulled up on my tablet checking which roads were clear.

The result: after 1 1/2 hours in the car and still the wrong side of central London I abandoned the driver to his fate. Bags and all, I jumped out at an underground station and took a delightfully smooth 12-minute journey to my destination and learned a lesson: Stick to what you know and trust your instincts.

Bob Geldof, the former Boomtown Rats frontman and "Live Aid" charity fund-raiser, confirmed his contrarian reputation when asked at a reception for boxing legend Muhammad Ali if he was excited about the games.

"Nope."

But, Geldof conceded, the games have at least brought much-needed regeneration to a post-industrial swath of east London ? transformed from gritty to green by the 500-acre (200-hectare) Olympic Park.

A SPANISH OLYMPICS?

As the debt-ridden Spanish government hovers on the brink of needing a sovereign bailout, the country is continuing to pursue a bid for the 2020 Olympics. Spanish sports secretary Miguel Cardenal maintains that Madrid winning the Olympics after two failed bids would help the country's economic recovery.

"The Spanish state is calling for its citizens to tighten its belts to accept the need for a degree of sacrifice and the measures are certainly painful," Cardenal said in London. "But we would nevertheless pursue this project," he said, saying that "this is something that will boost our aspirations to have a sustainable economy."

Bidding again, Cardenal insists Madrid will only spend where "absolutely necessary," but pointed out that much of the infrastructure is already in place.

"All of us will have to be very careful indeed in the way we use public funds," Madrid mayor Ana Botella added.

Missing out on the London Games, which start on Friday, appears to have been good fortune for a Spanish government struggling to keep a handle on its debts. Now there's time for a recovery in the Spanish economy long before 2020.

Madrid is competing against Istanbul and Tokyo. The host of the 2020 Olympics and Paralympic Games will be announced on Sept. 7, 2013 in Buenos Aires, Argentina.

Of my two parents? deaths, the death of my mother was the more significant for me. Partly because it came first, and partly because it was more sudden. It wasn?t a fading away, like Daddy?s. It was a decision she made, one day and then the next. It was really hard when my mom died. When my dad died it was more of a relief, because by the time it came he was really practically a vegetable; that?s what his life had become at that point.

I cried every day for months after Mummy?s death.

?Because it had gotten so horrid, she took her own life.?

She died from osteoporosis, from the pain in that illness. Because it had gotten so horrid, she took her own life. I remember going in to see her in the hospital in Boston. She was on her back, recovering from surgery. She asked me to bring her sleeping pills, which she kept in this little wooden box by her bed. She took them from me in a little handkerchief and put them under her pillow. I knew what she wanted them for, but she didn?t tell me that, not outright. But I knew, we all knew. It was just the way she lived her life. It made sense to us; she was in so much pain. But those pills weren?t strong enough. So she just went on with her choice. She asked another family member of ours, who had access to stronger pills, and this person brought them to her. I spoke to her the day before she died, and just like before, she didn?t have to tell me, but there was something in the way we spoke to each other, something about the conversation, I just knew. I remember, the last thing she said to me: I said ?Goodbye, Mummy, I wish I was there with you.? And she said, ?Don?t say goodbye, say au revoir.?

The next morning, back home in California, I heard that she?d died.

Well, my whole life sort of shifted on its foundation after that, and the best way I can explain is that she, more than Daddy, was the link to my past. She knew everything that I had been through. My childhood, young adulthood, it was all contained in her.

?I feel like it wasn?t really until they died that I grew up, when it was forced upon me.?

I used to wonder before she died if there would be a sense of freedom. And there was. She was my moral foundation when I was growing up. Even now I find myself doing it ? I was always double-checking the decisions I made, what she might think, what she would have done. Sometimes it felt like a burden. But there are certain times when I wish I could turn to them for advice. I feel like it wasn?t really until they died that I grew up, when it was forced upon me.

Her death brought my brother and I together. We began to completely lean on each other. We never used to get along so well, but now, we took a road trip together and talked nonstop. We?re like best friends now.

But Daddy died very differently. For him death was drawn out. We all saw it coming, long before it happened, in fact, we were there. I was there, watching him die, and it was incredible. I just stroked his arm, he lying there in the hospital bed, and I swear to God, when he breathed his last breath, he turned towards me. I did the drawings of him then, in Boston.

Poll: Few think Romney's faith resembles their own

WASHINGTON (AP) ? Most of America doesn't relate to Mitt Romney's religion, but that may not matter in his race against President Barack Obama.

Those are the findings of a new Pew Research Center poll released a month before Romney is set to become the first Mormon presidential nominee of a major political party.

The survey found widespread misgivings about the Mormon religion.

Nearly two-thirds of non-Mormons see Romney's faith as very different from their own. Just half consider it a Christian faith.

The survey also found that those who know Romney is a devout Mormon say they are comfortable with his religious beliefs.
